These Terms of Service apply to all services provided by Encourage Group. By engaging our services or using our website, you agree to these terms.
Our Services
Encourage Group provides Applied Behaviour Analysis (ABA) therapy, Positive Behaviour Support (PBS), assessments, consultations, training, and related support services.
All services are delivered based on professional standards, evidence-based practice, and the information provided to us by participants, families, and carers.
Service Delivery

Services may be delivered in the home, educational settings, community environments, or via other agreed methods

Service frequency and intensity are based on clinical recommendations and available funding

Encourage Group reserves the right to modify service delivery where clinically appropriate or required for safety
Appointments and Cancellations

Appointments must be cancelled with sufficient notice, as outlined in your service agreement

Late cancellations or non-attendance may incur a fee, in line with NDIS guidelines or private billing arrangements

Encourage Group may cancel or reschedule appointments due to illness, safety concerns, or unforeseen circumstances
Fees and Payments

Fees are outlined in your service agreement or provided prior to service delivery

Payment terms depend on whether services are NDIS-funded, plan-managed, self-managed, or privately paid

Outstanding invoices must be paid within the agreed timeframe
Encourage Group reserves the right to suspend services if payments remain overdue.
Participant Responsibilities
You agree to:

Inform us of any changes that may affect service delivery

Ensure a safe and appropriate environment for therapy

Treat staff with respect and courtesy
We reserve the right to withdraw services if staff safety is compromised
Confidentiality and Privacy
Personal information is handled in accordance with our Privacy Policy and applicable Australian privacy laws. Confidential information will only be shared with consent or where required by law.
Intellectual Property
All materials provided by Encourage Group, including reports, assessments, therapy plans, and training resources, remain the intellectual property of Encourage Group unless otherwise agreed in writing.
These materials must not be copied, shared, or distributed without prior consent.
Limitation of Liability
Encourage Group takes reasonable care in delivering services. However, outcomes cannot be guaranteed, as progress depends on many individual factors.
To the extent permitted by law, Encourage Group is not liable for indirect, incidental, or consequential loss arising from the use of our services.
Termination of Services
Either party may end services in accordance with the notice period outlined in the service agreement. Encourage Group may terminate services immediately if there is a serious breach of these terms or safety concerns.
